Scrap Muslim Reservation, says Hindus Sarv Jati Maha Panchayat

Agitated by allotting 4.5% quota out of Hindu OBC category and accepting recommendations of Sachchar committee and Rangnath Mishra committee by the Union Government, Hindu Sarv Jati Mahapanchayat (all cast Maha Panchayat of Hindus) today resolve to scrap it. Addressing the Mahapanchayat first ever called by VHP in Delhi the international working president of VHP Dr Parvin Bhai Togadia said that govt. of Bharat must scrape it in the national interest as the decision is unconstitutional and would pace the pay for another division of the country on religious lines. Muslims and their leaders who want reservation must be sent to Pakistan, he lauded.
Addressing the large gathering in TalKatora indoor stadium, the Janta Party supreme Dr Subhramanyam Swami said that when Muslim have ruled us for over 500 years and Christians for over 200 years then how they could be requires reservation. When there is No cast in these two, there is No question of any type of reservation, he asserted.

‘Hindu Roti-Shiksha Bachao’ agitation (save Hindu Roti & Education) was also launched in the program. The program compared by Gurdeen Prasad Rustagi, state secretary-VHP was also addressed by the president of 301 villages in Delhi, Valkiki saint Acharya Vivek nath ji, Acharya Mahendra Pal Arya  & swami Raghavanand. The VHP Vice President Om Prakash Singhal, Int’l joint General secretary swami Vigyananand, secretary Jugal Kishore, state president swadesh Pal Gupta, gen secretary Satyendra Mohan were amongst those dignitaries present at the occssion.

Presidential Reference on 2G Licensing

On 12th April 2012 the Government filed a Presidential Reference under Article 143(1) of the Constitution before the Supreme Court on the questions of law & facts arising out of the 2nd February 2012  judgment of the Supreme Court.

 

 The specific points on which the Presidential Reference has been referred to the highest court are given below:-

 

Q.1    Whether the only permissible method for disposal of all natural resources across all sectors and in all circumstances is by the conduct of auctions?

 

Q.2    Whether a broad proposition of law that only the route of auctions can be resorted to for disposal of natural resources does not run contrary to several judgments of the Supreme Court including those of Larger Benches?

 

Q.3    Whether the enunciation of a broad principle, even though expressed as a matter of constitutional law, does not really amount to formulation of a policy and has the effect of unsettling policy decisions formulated and approaches taken by various successive governments over the years for valid considerations, including lack of public resources and the need to resort to innovative and different approaches for the development of various sectors of the economy?

 

Q.4    What is the permissible scope for interference by courts with policy making by the Government including methods for disposal of natural resources?

 

Q.5    Whether, if the court holds, within the permissible scope of judicial review, that a policy is flawed, is the court not obliged to take into account investments made under the said policy including investments made by foreign investors under multilateral/ bilateral agreements?

 

Q.6    If the answers to the aforesaid questions lead to an affirmation of the judgment dated 02.02.2012 then the following questions may arise, viz.

 

(i)   Whether the judgment is required to be given retrospective effect so as to unsettle   

     all licences issued and 2G spectrum (800, 900, and 1800 MHz bands) allocated in      

     and after 1994 and prior to 10.01.2008?

Ii)      Whether the allocation of 2G spectrum in all circumstances and in all specific

            cases for different policy considerations would nevertheless have to be undone?

 

And specifically

 

(iii)    Whether the telecom licences granted in 1994 would be affected?

 

(iv)    Whether the Telecom licences granted by way of basic licences in 2001 and licences granted   between the period 2003-2007 would be affected?

 

(v)     Whether it is open to the Government of India to take any action to alter the terms of any licence     to ensure a level playing field among all existing licensees?

 

(vi)    Whether dual technology licences granted in 2007 and 2008 would be affected?

 

(vii)   Whether it is necessary or obligatory for the Government of India to withdraw the Spectrum  allocated to all existing licensees or to charge for the same with retrospective effect and if so on what basis and from what date?

 

Q.7    Whether, while taking action for conduct of auction in accordance with the orders of the Supreme Court, it would remain permissible for the Government to:

 

(i)            Make provision for allotment of Spectrum from time to time at the auction discovered price and in accordance with laid down criteria during the period of validity of the auction determined price?

 

(ii)          Impose a ceiling on the acquisition of Spectrum with the aim of avoiding the emergence of dominance in the market by any licensee/applicant duly taking into consideration TRAI recommendations in this regard?

 

(iii)    Make provision for allocation of Spectrum at auction related prices in accordance with laid down criteria in bands where there may be inadequate or no competition (for e.g. there is expected to be a low level of competition for CDMA in 800 MHz band and TRAI has recommended an equivalence ratio of 1.5 or 1.3X1.5 for 800 MHz and 900 MHz bands depending upon the quantum of spectrum held by the licensee that can be applied to auction price in 1800 MHz band in the absence of a specific price for these bands)?

 

Q.8    What is the effect of the judgment on 3G Spectrum acquired by entities by   auction whose licences have been quashed by the said judgment?

           

The Presidential reference is listed for hearing in Supreme Court on 10th July 2012.

NOW ATTACKS ON JUDGES : PRIME MINISTER SHOULD REMOVE CHIDAMBARAM – VIJENDER GUPTA

BJP Delhi Pradesh President Shri Vijender Gupta has said that attack in Judges within a week in Delhi are direct example of failed law and order in Delhi and has further added that the common man was completely unsafe in Delhi but the broad daylight attack by the criminals on the Judges have proved that Home Minister P. Chidambaram is not managing the affairs of Home Ministry.  Prime Minister should remove Home Minister P. Chidambaram from his post and should appoint another competent person in his place.

It may be mentioned that on the 14th May, Additional Chief Metropolitan Magistrate Sanjeev Sharma of Saket Court was attacked and now again criminals have attacked an assaulted three of Saket Court S. Sh. Ajay Garg, Indrajit Singh and Manoj Kumar at Dakshinpuri when they were in there Esteem Car. In this attack Magistrate was seriously injured and he is in ICU.

Shri Gupta said that the criminals in Delhi are not afraid of rule of law. So far they were attacking and looting common man but now they are attacking Judges, Magistrates and Policemen on duty. Some days ago when a Police Constable Naresh was on his duty and he wanted to stop some bikers then they killed Constable Naresh. Similarly, two children were subjected to sexual crime in Indrapuri and Vijay Vihar. In Defence Colony, a bag containing half portion of dead body was recovered. These incidents expose the failure of Delhi Police.

Taking these incidents seriously, former Judges of High Court Justice Arya Sodhi and Justice Shiv Narayan Dhingra  have said that when Judges are been attacked openly in any State then how the Judges shall work fearlessly. The people shall loose their trust in Judiciary. This situation is dangerous for a civilized and developing society.

MAYORS OF SOUTH AND NORTH DELHI ASKS THE COMMISSIONERS TO STALL THE PROCESS OF TRANSFERRING IMMOVABLE PROPERTY TO DELHI GOVERNMENT

Mayor of South Delhi, Mrs. Savita Gupta in a letter to Commissioner, South Delhi Municipal Corporation has asked to stall the proceedings to hand over the property to DSIDC until it is approved by the Corporation under the DMC Act, 200 (C) & (D), which envisage that no land or building can be transferred or sold without the prior approval of the Municipal Corporation. 
          The Mayor said that it is learnt that the portion of the office of the Property Tax Department situated at Lajpat Nagar Ring Road which is a prime location and land costs in crores is being transferred to the DSIDC in lieu of the portion of the building of Udyog Sadan, Patparganj Industrial Area, where the Headquarter of the East Delhi Municipal Corporation is being developed.
          Mrs. Savita Gupta also sought the information regarding other properties which are being transferred in lieu of the portions of Udyog Sadan of DSIDC at Patparganj Industrial Area,
          Similar to this, the Mayor of North Delhi, Mrs. Mira Aggarwal has also sought the details of the property at Nigam Bhawan, Old Hindu College at Kashmere Gate which is also in process of transfer to Delhi Govt. She has also asked the Municipal Commissioner of North Delhi to stop the process unless and until it is approved by the Municipal Corporation of North Delhi under the provisions of the Section 200 (C) & (D).  She added otherwise the immovable property would not have legal sanctity and would be in clear violation of the Act.
